Abstract

This contribution aims to start a debate on some legal considerations regarding the choice between public and private law regimes with regard to safeguarding and promote public values. Thus this ‘paper’ is limited to presenting some questions and possible answers and considerations. The focus lies with the proposed questions on ‘who defines public values’ and ‘who is in charge of safeguarding public values.’
